1.1 The physical reality: Cold kills faster than darkness

According to DIN SPEC 1946-7:2022-05, section 5.3.1:

“In facilities with people in need of care, a minimum temperature of 20 °C must be maintained in living areas for at least 24 hours even in the event of failure of the main power supply.”

Without emergency power for heating circulation pumps and hot water preparation, a critical condition occurs within a very short time:

  • 0–60 minutes: Temperature drop in heating circuits → cold radiators
  • 60–120 minutes: Room temperature below 18 °C → acute hypothermia risk for bedridden residents

1.2 The legal reality: Personal liability of decision-makers

According to BGB § 823 Paragraph 1:

“Whoever intentionally or negligently unlawfully injures the life, body, health [...] of another is obliged to compensate the other for the resulting damage.”

According to Occupational Health and Safety Act § 3 Paragraph 1:

“The employer is obliged to take the necessary occupational safety measures, taking into account the hazards to employees and third parties.”

The consequence: Failure to provide for heat supply during a power outage is considered by courts as a grossly negligent breach of duty – with personally liable management and nursing home leadership. The Berlin blackout has shown: Insurance provides no protection if preventive measures are demonstrably omitted.

2. LEGAL FRAMEWORK: Precise classification beyond KRITIS misunderstandings

2.1 Clear positioning: Nursing homes are NOT KRITIS facilities – but...

According to BSI-KritisV § 2 Paragraph 1 No. 7:

“KRITIS facilities in the health sector are hospitals with more than 30,000 inpatient treatment cases per calendar year.”

Nevertheless, stricter obligations apply:

Since the entry into force of the Act to Strengthen Information Technology Security (IT-SiG 2.0) in May 2024:

“Operators of special facilities must take appropriate measures to maintain functionality in the event of disruptions to the energy supply and document these in a resilience plan.”

Nursing homes are among the “special facilities” according to § 2 No. 15 BSIG – regardless of KRITIS status. The documentation obligation for resilience measures is therefore legally binding.

“Stationary diesel storage tanks > 1,000 liters must be fire-protected (F90), secured against overfilling, and equipped with leak detection. Minimum distance to living areas: 5 meters.”
